Chile<\/em>, el 12 de marzo de 2024, en la cual se declar\u00f3 la responsabilidad internacional de Chile por la violaci\u00f3n de los derechos a las garant\u00edas judiciales y protecci\u00f3n judicial, as\u00ed como el derecho a la integridad personal, en relaci\u00f3n con los cr\u00edmenes de lesa humanidad ocurridos durante la dictadura militar.<\/p>\n<p>El fallo hace referencia a la aplicaci\u00f3n de la \u00abmedia prescripci\u00f3n\u00bb o \u00abprescripci\u00f3n gradual\u00bb por parte de la Corte Suprema de Chile en juicios penales entre 2007 y 2010. Este concepto, estipulado en el art\u00edculo 103 del C\u00f3digo Penal chileno, permiti\u00f3 la reducci\u00f3n significativa de las penas impuestas a los responsables de desapariciones forzadas y ejecuciones extrajudiciales. La Corte Interamericana determin\u00f3 que esta figura favoreci\u00f3 la impunidad y vulner\u00f3 los derechos de las v\u00edctimas y sus familiares.<\/p>\n<p>El Estado de Chile reconoci\u00f3 parcialmente su responsabilidad, admitiendo que la media prescripci\u00f3n vulner\u00f3 los derechos a un proceso judicial justo y efectivo. Sin embargo, la Corte destac\u00f3 que persisten obligaciones estatales en cuanto a investigar y sancionar adecuadamente estos cr\u00edmenes, sin que se apliquen figuras que puedan atenuar las penas de manera irrisoria.<\/p>\n<p>Como medidas de reparaci\u00f3n, la Corte orden\u00f3 a Chile revisar las reducciones de penas que se derivaron de la aplicaci\u00f3n de la media prescripci\u00f3n y adecuar su marco jur\u00eddico para evitar que esta figura se aplique en casos de cr\u00edmenes de lesa humanidad.<\/p>\n<p>Esta sentencia representa un avance crucial en la lucha por la justicia para
